These Terms and Conditions constitute a legally binding agreement between you (the Client) and Ayxqo (the Company). By using our website or purchasing any of our managed/unmanaged IT services, you acknowledge that you have read, understood, and agreed to be bound by these terms.
⇒ Account Management

- Accuracy of Information: To access our IT solutions, domains, or hosting, you must provide current, complete, and accurate information (Name, Email, Phone, and Organization).
- Verification: Ayxqo reserves the right to verify your identity. Providing false information may lead to immediate account termination without notice.
- Age Requirement: You must be at least 18 years old to create an account and enter into a binding legal agreement.

- Password Protection: You are solely responsible for the activity that occurs on your account. You must keep your account password secure.
- Unauthorized Use: You must notify Ayxqo immediately of any breach of security or unauthorized use of your account.
- Accountability: Ayxqo will not be liable for any losses caused by any unauthorized use of your account. However, you may be liable for the losses of Ayxqo or others due to such unauthorized use.

- Client Access: You maintain full administrative control over your purchased services (Hosting, Software, or Domains).
- Support Access: By requesting Managed Support Services, you grant Ayxqo technical staff temporary permission to access your account or server environment to troubleshoot or perform maintenance.
- Collaboration: For Meta Business Support, you may be required to add Ayxqo as a “Partner” or “Admin” within your Meta Business Manager.

- Store or distribute malware, viruses, or illegal content.
- Engage in phishing, spamming, or unauthorized hacking attempts.
- Violate the intellectual property rights of Ayxqo or third parties.

- Non-Payment: Failure to pay for recurring services (Hosting, Managed Support, Domain) will result in account suspension.
- Policy Violation: Ayxqo reserves the right to terminate any account level access if these Terms and Conditions are breached.
- Data Deletion: Upon account termination, Ayxqo is not obligated to maintain your data. All hosted files, emails, and configurations will be permanently deleted after a 14-day grace period.
- Service Portability: You have the right to transfer your domain or hosting to another provider. However, all outstanding dues must be cleared before the transfer authorization (EPP/Auth Code) is released.
- Internal Transfer: Moving services between two Ayxqo accounts requires verified consent from both parties.

At Ayxqo, we do not sell your personal information. We only share your data with trusted third parties to provide our services, maintain security, and comply with legal obligations.

- Domain Registries: When you register a domain, your contact info is shared with registries (like Verisign or ICANN) to confirm ownership.
- Hosting Infrastructure: We may share technical data with data centers and server management tools (like cPanel or LiteSpeed) to maintain your hosting environment.
- Third-Party Platforms: For Meta Advertisement and SEO, we share relevant business data with platforms like Meta (Facebook/Instagram) and Google to execute your marketing campaigns.
3. Legal and Law Enforcement
We may disclose user information if required by law, such as:

- To comply with a court order or legal process.
- To protect the rights, property, or safety of Ayxqo, our customers, or the public.
- To report or prevent illegal activities like hacking, phishing, or fraud.
5. With Your Consent
We may share your information with other third parties only if you have given us explicit permission to do so (e.g., for a joint case study or specific IT Consultancy collaboration).
This policy outlines the rules for using the services provided by Ayxqo. To maintain a secure and reliable environment for all our clients, we strictly enforce these standards. This Abuse Policy is a part of the master agreement between Ayxqo and the User. We maintain a zero-tolerance policy regarding any activity that disrupts our “Secure and Reliable” service promise.

- Illegal Activity: Content that promotes or facilitates illegal acts under international or local laws.
- Copyright Infringement (DMCA): Hosting pirated software (warez), nulled scripts, or any media without the owner’s consent.
- Harmful Content: Child Sexual Abuse Material (CSAM), hate speech, or content that promotes self-harm, terrorism, or violence.
- Fraudulent Content: Sites intended to deceive users, including “get rich quick” schemes, fake investment sites, or fraudulent retail stores.

- Resource Overuse: Using excessive CPU, RAM, or Disk I/O that affects the performance of other clients on a shared server.
- Unauthorized Access: Any attempt to probe, scan, or test the vulnerability of our systems or to breach security/authentication measures.
- DDoS & Attacks: Hosting “booter” or “stresser” scripts or participating in any form of Denial of Service attacks.
- Proxy & VPN: Using web hosting accounts to run public proxies, VPNs, or TOR relays.

- Unsolicited Bulk Email (UBE): Sending mass emails to recipients who have not explicitly opted-in to your mailing list.
- Mail Bombing: Sending a large volume of emails to a single address to disrupt their service.
- Spoofing: Forging email headers to hide the true origin of a message.
- Blacklisting: Any activity that results in Ayxqo’s IP addresses being blacklisted by major mail providers (Gmail, Outlook, etc.).

- Deceptive Ads: Running ads that lead to “bait and switch” landing pages.
- Bypassing Systems: Using techniques to bypass Meta’s ad review process or automated security checks.
- Identity Theft: Using our Art & Design services to create fake documents or identities for Meta account verification.

- Vulnerable Scripts: Clients are responsible for keeping their software (WordPress, Plugins, etc.) updated. If an outdated script is compromised, Ayxqo may suspend the account to prevent further spread of malware.
- Botnets: Running IRC bots or any automated scripts that connect to a command-and-control server is strictly forbidden.

- Immediate Suspension: Temporary disablement of the service without prior warning.
- Account Termination: Permanent deletion of all data and account access.
- Financial Penalty: A “Clean-up Fee” may be charged for accounts involved in massive spam or malware outbreaks.
- Legal Reporting: We cooperate fully with law enforcement and will provide logs and subscriber information if legally requested.

Ayxqo respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond quickly to claims of copyright infringement committed using the Ayxqo services (Hosting, Websites, or Servers) that are reported to our Designated Copyright Agent.
- Shared, VPS, and Dedicated Hosting.
- Managed Website Content (WordPress/Custom Sites).
- Stored Files, Images, and Software code.
- Art & Design work delivered to clients.

- Identification of the copyrighted work that you claim has been infringed.
- Identification of the material that is claimed to be infringing and its specific location (the exact URL or link).
- Contact Information: Your address, telephone number, and email address.
- A Statement of Good Faith: A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

- Expeditiously remove or disable access to the allegedly infringing material.
- Notify the affected customer that the material has been removed.
- Maintain a record of the notice for legal compliance.

- The counter-notice must include the customer’s contact details and a statement consenting to the jurisdiction of the federal court.
- If Ayxqo receives a valid counter-notice, we may restore the material within 10 to 14 business days, unless the original complaining party files a court action against the user.

- We will terminate the accounts of users who are found to be repeat infringers.
- In the event of account termination due to repeat infringement, no refunds will be issued for any pre-paid services.

8. “Fair Use” Consideration
Before submitting a notice, the complaining party is encouraged to consider whether the use of the material constitutes “Fair Use” (such as criticism, comment, news reporting, teaching, or research). Ayxqo reserves the right to ask for clarification if a notice appears to target Fair Use content.
10. Trademark and Other IP Issues
This policy also extends to Trademark Infringement.

- If you believe a client is using your Trademarked name or logo in a way that causes confusion, please provide your Trademark Registration Number and the jurisdiction of registration.
- Ayxqo will review Trademark complaints on a case-by-case basis and may request further evidence before taking action.
12. Limitations of Ayxqo’s Liability
As a Service Provider (OSP), Ayxqo acts as a passive conduit for data. We are not responsible for:

- Pre-screening content uploaded by users.
- Monitoring the legality of every file on our servers.
- Legal disputes between copyright owners and our clients.
